By accessing or using the Breath mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of the terms, you may not access the App.
The App provides breathwork and meditation guidance for relaxation and stress reduction purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment.
Consult with a healthcare professional before starting any new breathing or meditation practice, especially if you have any pre-existing medical conditions (such as respiratory issues, heart conditions, or anxiety disorders). If you experience any discomfort, dizziness, or distress while using the App, stop immediately and consult a doctor.
The App and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Breath Team and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download and install a copy of the App on a mobile device that you own or control and to run such copy of the App solely for your own personal, non-commercial purposes.
You agree not to use the App for any unlawful purpose or in any way that could damage, disable, overburden, or impair the App.
In no event shall Breath Team, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
